3. How We Use Information
We use information to create and secure family accounts, provide educational and AI-assisted features, personalise age-appropriate learning, deliver verification and password-reset emails, process subscription entitlements, prevent abuse, respond to support requests, improve reliability, and comply with legal obligations. If you are located in the European Economic Area (EEA) or the United Kingdom, we process personal information on the following legal bases: (a) the consent of a parent or guardian, for creating child profiles and processing photos, voice recordings, questions, and other submitted content, which may be withdrawn at any time; (b) performance of a contract, to provide the App features and services you request; (c) our legitimate interests in operating, securing, and improving the App, subject to the safeguards described in this policy; and (d) compliance with legal obligations, the protection of children, and the establishment or defense of legal claims.
4. Children's Privacy
WhySy Kid is designed for children aged 3-12 under the supervision of a parent or guardian. The family account is created and controlled by an adult. We do not knowingly allow a child to create an independent account or collect personal information directly from a child without the involvement and consent of a parent or guardian. A parent or guardian may request access, correction, deletion, or withdrawal of consent.
5. Sharing and Service Providers
We do not sell or rent personal information. We may disclose only the information needed to contracted providers that support cloud hosting and storage, authentication, email delivery, speech and AI processing, app-store billing, analytics, security, and customer support. We may also disclose information when required by law or to protect users and the service.
6. Data Retention and Deletion
We retain information while the family account is active and for the period needed to provide the service, resolve disputes, maintain security, and meet legal obligations. A parent or guardian can request account deletion through our account deletion page. We aim to complete verified deletion requests within 30 days unless a longer retention period is required by law.
7. Your Choices and Rights
Depending on your location, you may have rights to access, correct, delete, restrict, or object to processing, and to receive a portable copy of personal information. If you are located in the EEA or the United Kingdom, you also have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal, and the right to lodge a complaint with your national data protection supervisory authority. Parents and guardians may also review or delete information associated with a child profile. To exercise any of these rights, send requests to [email protected]. We will respond within the timeframe required by applicable law.
8. Security and International Processing
We use administrative, technical, and organisational safeguards designed to protect information. No system can guarantee absolute security. Service providers may process information in countries other than the user's country, subject to applicable contractual and legal safeguards. For users in the EEA and the United Kingdom, personal information transferred outside those regions is protected by appropriate safeguards, such as the European Commission's Standard Contractual Clauses or equivalent transfer mechanisms. Soula LLC has appointed Nick Nie as its representative in the European Union under Article 27 of the GDPR, who can be contacted at [email protected].
9. Changes to This Policy
We may update this policy when the product, service providers, or legal requirements change. Material changes will be communicated through the App, website, or the guardian account email as appropriate. The effective date above identifies the current version.
